Pine Bluff, Arkansas is TOO LOUD! Letter to Pine Bluff’s administration and Chamber of Commerce…

Dear Mayor Washington,

I had the pleasure of visiting your beautiful municipality for a few days during the Labor Day weekend. I was disheartened to see that Pine Bluff, its administration, its law enforcement community, obviously care very little about the quality of life and domestic tranquility, the basic fundamental rights of life, liberty, the pursuit of happiness as you have surrendered your City, your personal integrity, to the narcissistic thugs who assault your citizenry with impunity via the unencumbered operation of illegally LOUD, illegally equipped, large displacement motorcycles, automobiles, pick-up trucks. These vehicles have been illegally modified to emit decibel levels that are easily audible for over one-mile under hard acceleration; decibel levels that are in multiples (logarithmic) of the legal, total, relatively safe, 80dB(A) as mandated by the US EPA.

Arkansas’ motor vehicle muffler law § 27-37-601 clearly prohibits the operation of a motor vehicle on the public roadways of Arkansas equipped with a muffler that fails to conform to the noise suppression qualities of the original factory-installed muffler. Arkansas’ State Legislature obviously cared about the quality of life of Arkansas citizenry when they passed this excellent motor vehicle muffler legislation; unfortunately, Arkansas’ enforcement entities are too compromised, lazy, or inept, to enforce the protective intent of said law.

Arkansas § 27-37-601 (b) prohibits the retail of mufflers that violate this statute; so I ask you, why are you permitting motor vehicle noise thugs to destroy the domestic tranquility of your citizenry and audibly assault your most innocent with impunity void intercession by “peace” officers? Why is Chief Franklin allowed to continue in his failure to provide the most basic of governmental responsibilities i.e. protection? Why is your law enforcement community impotent in their responsibility to protect your most innocent and most susceptible to the illegal motor vehicle noise destroying your community e.g. children, the elderly, the handicapped?

2010 Arkansas Code Title 27 – Transportation Subtitle 3 – Motor Vehicles And Their Equipment Chapter 37 – Equipment Regulations Subchapter 6 – Mufflers § 27-37-601 – Noise or smoke producing devices prohibited.

(a) Every motor vehicle shall, at all times, be equipped with a factory-installed muffler or one duplicating factory specifications, in good working order and in constant operation, to prevent excessive or unusual noise and annoying smoke.

(b) No person shall use on a motor vehicle upon the public roads, highways, streets, or alleys of this state, nor shall any person sell for use on a motor vehicle upon the public roads, highways, streets, or alleys of this state, a muffler, other than as defined in subsection (a) of this section, cutout, bypass, similar device, or any type device which produces excessive or unusual noise or smoke.
