Illegally LOUD motorcycles, automobiles, trucks, operating with impunity in Montrose, Colorado…shameful! Letter to the editor, Montrose Press…
My wife and I are touring the United States searching for a home, perhaps a little property and what we’ve found thus far is a Nation whose highways and byways and surface streets are inundated with LOUD, selfish, narcissistic asses operating illegally equipped, illegally LOUD motor vehicles and our police are apparently impotent, cowardly, compromised and refuse to stop the illegal madness. I will not invest my money or subject my family to the unlawful intrusion of illegally LOUD motor vehicles which is a reflection on the care and concern of the law enforcement and administrative office holders in these incredibly noisy municipalities.
Thus far, “some” these nosiest municipalities, concerning illegally LOUD motor vehicles, we’ve entered are Houston, Eagle Pass, Tx; El Paso, Tx; Roswell, NM, Phoenix-Peoria, AZ; Las Vegas, NV; Portland, OR; Port Angeles, Monroe, Spokane, WA; Butte, Ennis, MT; Vernal, Salt Lake City, Provo, UT; Grand Junction; Montrose, CO.
Letter to the Montrose Press Newspaper, Montrose, Colorado,
The impotency and failures of the Montrose, Colorado Police Department and Mayor Glaspell to enforce the motor vehicle noise laws in Montose, Colorado is mind boggling. I am visiting this beautiful city for ten-days and I am appalled, insulted, that illegally LOUD motorcycles, automobiles, trucks (diesel and gasoline), are allowed to audibly assault the citizenry, day and night, with impunity, while apparently NOTHING is done to enforce Colorado’s Muffler Statute (§ 42-4-225) requiring motor vehicles to be equipped with a muffler meeting the noise suppressing qualities/specifications of the original muffler affixed to the vehicle by the manufacturer.
One element of § 42-4-225 states: “No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of such vehicle above that emitted by the muffler originally installed on the vehicle, and such original muffler shall comply with all of the requirements of this section.”
Motorcycles are limited to a total noise emissions of 80 dB(A); that is, every moving part, in combination, on the motorcycle cannot emit more than a relatively quiet 80dB(A) as mandated by the US EPA’s J331a full-throttle drive testing procedure. 80+% of the motorcycles operating on the public roadways of Montrose are illegally equipped with “not for road use” aftermarket exhausts or the operator has illegally tampered with the factory exhaust to make it LOUDER. Passenger trucks are also limited to 80dB(A) by the EPA but far too many auto’s and trucks in Montrose are illegally equipped with Flowmaster or Magnaflow or any other aftermarket exhaust designed to make intrusive and dangerous NOISE.
Allowing your citizenry to be audibly assaulted by narcissistic thugs who care nothing for the health and welfare of our most innocent, our families, this is law enforcement apathy and this is wrong. Government’s FIRST duty to its citizenry is “protection,” and the Montrose, Colorado PD, the Colorado State Police, the Mayors and Council members of Colorado’s municipalities, are guilty of malfeasance, neglect of duty, apathy, laziness, cowardliness, compromise, a combination thereof…shameful.
Sincerely,
Rickey D. Holtsclaw
