Dear Governor Ron DeSantis and Lee County Commissioners,
Why does Lee County, Florida allow our most innocent in Cape Coral, Fort Myers, Pine Island, to be audibly abused, harassed, their daily quality of life destroyed, their health and welfare compromised, by aggressive, illegally LOUD, motorcycles, trucks, automobiles, like those in the following videos, a mere sampling, of what I have recorded recently?
If Lee County’s Sheriff’s Department, the Cape Coral and Fort Myers PD, would actually enforce Florida’s State Law requiring the relatively quiet, safe, legal, factory-installed muffler and use illegal motor vehicle NOISE as probable cause for a vehicle stop and investigate, Lee County could cut their serious accidents and fatalities by 50% via stopping the aggressive driving behavior which is overwhelmingly accompanied by illegal vehicular NOISE.
If you have any questions, if you need someone capable of initiating a motor vehicle NOISE enforcement program, I can help you, but something needs to be done, NOW!

It would also be in the best interest of Lee County if the Commissioners would STOP allowing Cape Coral’s, Fort Myers’, Mayors from prostituting themselves and prostituting their Law Enforcement Agencies with the illegally LOUD Biker Cult[ure] via motorcycle “Bike Nights,” Rallies, flagrant vehicular NOISE abuse in the Downtown streets of Fort Myers; this, for revenue garnered via tax revenue. Our Sheriff, these Mayors, are openly flaunting Florida’s Muffler Statute that requires the OEM, quiet, safe, legal, factory-installed muffler.
Why do you Commissioners do nothing to counter this abuse of the citizenry, our children, the elderly, our handicapped, our families, as these illegally LOUD motorcycle thugs, LOUD auto and truck thugs, operate unencumbered in YOUR areas of responsibility?
Recently, subsequent my report of illegally loud, illegally equipped, police motorcycles forwarded to Lee County’s Legal Department, Lee County’s own Police Motorcycle Detail was warned to return their illegally loud, Cobra aftermarket exhaust equipped motorcycles back to OEM-factory installed condition in compliance with Florida’s State muffler law. That embarrassing fiasco can be seen here: https://rickeyholtsclaw.com/2022/05/03/lee-county-floridas-legal-department-does-the-right-thing/
This following paragraph from Section 293 is very important as it restricts using any non-original equipment which can increase noise limits on cars or other vehicles:
(5) NOISE ABATEMENT EQUIPMENT MODIFICATIONS.— Florida State Law
“(a) No person shall modify the exhaust system of a motor vehicle or any other noise-abatement device of a motor vehicle operated or to be operated upon the highways of this state in such a manner that the noise emitted by the motor vehicle is above that emitted by the vehicle as originally manufactured.”
This makes it illegal to use any aftermarket modifications louder than ones your vehicle is manufactured with. All devices producing excessive exhaust noise are not legal. There are exceptions which include emergency vehicles, vehicles used in races or similar events, agricultural equipment, and test vehicles.
If you have any questions about the vehicular NOISE abuse in your jurisdiction, please see my article on this subject at: https://rickeyholtsclaw.com/2016/03/10/the-truth-about-loud-motorcycles-the-police-wont-or-cant-tell-you/
Thank you,
