Pervasive, Illegally LOUD motorcycles, auto’s, trucks, in Florida are generally operated by privileged, narcissistic, selfish, bullies, who abuse our most innocent, our children, our families, with their illegal, intrusive, NOISE that destroys the daily quality of life for millions; this, while a specific Florida State Motor Vehicle Noise Statute exists (§ 316.293 (5)) mandating the quiet OEM muffler affixed to all motor vehicles operated on the public roadways of Florida; this, while Florida’s law enforcement community is too compromised, too cowardly, too unconcerned, to use this illegal motor vehicle noise as “probable cause” to stop, investigate, cite, arrest, incarcerate, impound, the offensive and dangerous and intrusive behavior; this, while our Governor and Attorneys General and State Law Enforcement Administrators, Sheriffs, Police Chiefs, Mayors, Commissioners, look the other way, do absolutely nothing; this, while our State Legislators refuse to “criminalize” motor vehicle noise abuse and make it an impotent “civil” penalty subject to fines only. I love Florida, I hate the thugs who are not policed and privileged that destroy daily quality of life here and abuse our most innocent unencumbered by those sworn to protect and serve!

Vehicular NOISE abuse in Florida, some relevant questions…

  1. Can someone explain to me why Lee County enforcement officials refuse to protect and serve the most innocent, children – the handicapped – the elderly – our family members, from the audible abuse of illegally LOUD bikers, auto and truck operators, operating unencumbered on the public roadways of Lee County, Florida; this, when Florida’s State Motor Vehicle Law clearly prohibits the operation of these illegally LOUD motor vehicles by mandating a quiet muffler that meets the sound suppression capabilities of the OEM – factory-installed muffler that was affixed to the vehicle when manufactured? Why is the Cape Coral Police, Fort Myers Police, Lee County Sheriff’s Department, the State Highway Patrol, so very impotent and neglectful relevant to vehicular NOISE abuse? Does this misfeasance, malfeasance, stem from ignorance, apathy?
  2. Why have Florida’s State Legislators made violations of the Muffler Laws a “non-criminal civil offense” (fine only) as opposed to a “criminal physical assault” with escalating fines and incarceration for subsequent abusive offenses? Are Florida’s State Legislators and Governor DeSantis unconcerned about the health and welfare, the daily quality of life, of the Floridian, our families, our children, our elderly, the handicapped, who are abused by vehicular NOISE thuggery day and night, 24/7/365?
  3. Yes, the Legislator’s have recently enacted a noise law to address LOUD music “noise” emanating from motor vehicles, why NOT enforce the muffler laws as well and impound these offensive vehicles and incarcerate the abusers? How much longer must Florida’s residents suffer from the vehicular NOISE bullies? Where is the governmental intercession or are we expected to take matters into our own hands?

(5) Noise abatement equipment modifications.–

(a) No person shall modify the exhaust system of a motor vehicle or any other noise-abatement device of a motor vehicle operated or to be operated upon the highways of this state in such a manner that the noise emitted by the motor vehicle is above that emitted by the vehicle as originally manufactured.

(b) No person shall operate a motor vehicle upon the highways of the state with an exhaust system or noise-abatement device so modified.

Shame on the selfish BULLIES who abuse the children, the elderly, the families, on Pine Island, FL by operating an illegally LOUD, illegally equipped, motorcycle – automobile – truck on the public roadways that service Pine Island – Bokeelia – City Center – Saint James.

Shame on Lee County’s Sheriff Department, the Deputies, for their misfeasance – malfeasance – their refusal to enforce the factory-installed muffler requirements of the Florida State Motor Vehicle Code.

Shame on Lee County’s Sheriff Department for their refusal to protect and serve the citizens of Lee County, Florida who are daily and nightly subject to motor vehicle noise abuse; especially relevant, the abuse our children, our elderly, the handicapped, our families.

Sec. 316.293. Motor vehicle noise (Florida)

[…] No person shall operate or be permitted to operate a vehicle at any time or under any condition of roadway grade, load, acceleration, or deceleration in such a manner as to generate a sound level in excess of the following limit for the category of motor vehicle and applicable speed limit at a distance of 50 feet from the center of the lane of travel under measurement procedures […]

This following paragraph from Section 293 is very important as it restricts using any non-original equipment which can increase noise limits on cars or other vehicles:

(5) NOISE ABATEMENT EQUIPMENT MODIFICATIONS.—
(a) No person shall modify the exhaust system of a motor vehicle or any other noise-abatement device of a motor vehicle operated or to be operated upon the highways of this state in such a manner that the noise emitted by the motor vehicle is above that emitted by the vehicle as originally manufactured.

This makes it illegal to use any aftermarket modifications louder than ones your vehicle is manufactured with. All devices producing excessive exhaust noise are not legal. There are exceptions which include emergency vehicles, vehicles used in races or similar events, agricultural equipment, and test vehicles.
