Mayoral Prostitution with LOUD Biker Cult[ure] at “Bike Week” – Daytona, FL

During my 31-year tenure with the Houston PD, I served the citizens of Houston as a Motorcycle Patrol Officer, Radio Patrol Officer and in Air Support.

During my enforcement years, I cited, incarcerated, untold numbers of “men” who operated illegally LOUD motorcycles, auto’s, trucks, on our public roadways and these, with intent and some in ignorance, audibly abused the children, the elderly, the handicapped, the families, living and seeking a good daily quality of life, those who lived and worked in my areas of responsibility.

Furthermore, I’ve never understood why and how city leaders, mayors, of some of our largest municipalities in the United States e.g., Daytona, FL are permitted to whore themselves for tax revenue, graft, money, with the LOUD Biker Cult[ure] via illegal biker rallies; this, while the citizens of these municipalities are audibly assaulted day and night with illegal vehicular NOISE…these same citizens are the people, the families, these “mayors” took an oath to protect and serve.

316.293 Motor vehicle noise.—

(5) NOISE ABATEMENT EQUIPMENT MODIFICATIONS.—

(a) No person shall modify the exhaust system of a motor vehicle or any other noise-abatement device of a motor vehicle operated or to be operated upon the highways of this state in such a manner that the noise emitted by the motor vehicle is above that emitted by the vehicle as originally manufactured.

(b) No person shall operate a motor vehicle upon the highways of the state with an exhaust system or noise-abatement device so modified.

I’ve never understood why a man or woman would illegally modify a motor vehicle to emit illegal noise emissions in multiples (algorithmically) the legal, safe, total, noise emissions of 80dB(A) and do so absent care or concern.

To this very day, I remain baffled by those who ride and drive LOUD and think their behavior is somehow cool coupled with bravado when in reality, these are selfish bullies who abuse the innocent among us; essentially, domestic terrorists.

I’ve owned some 30-motorcycles since age 12 and I’ve accumulated hundreds-of-thousands-of-miles on those motorcycles, professionally and for pleasure. Why do far too many “men” find riding LOUD to be acceptable when Federal and State laws prohibit same specifically for the safety and quality of life of the American citizen?

Thank you for acceptance into this motorcycling group. I have owned approximately 30-motorcycles since age 12 and accumulated hundreds-of-thousands-of-miles on motorcycles while riding professionally as a motorcycle officer, long distance touring as well as a daily commuter in Houston traffic.

Over the years, I have become increasingly concerned about an abusive and illegal group of “LOUD bikers” who have turned the once honorable sport of motorcycling into a form of “domestic terrorism” via the operation of an illegally modified or illegally equipped motorcycle that abuses, daily, our children, our elderly, our handicapped, our families, destroying daily quality with illegal motorcycle NOISE; illegal aftermarket exhausts like the Vance and Hines “Big Radius” illegally LOUD exhaust pictured on this group’s main page photo. Our naive society has become conditioned to this abusive, dangerous, LOUD motor vehicle plague as the general public is unaware of the physiological dangers of unregulated motor vehicle NOISE.

I would personally like to see those who abuse our society with illegal motorcycle, auto, truck, NOISE cited, incarcerated, their illegally equipped motorcycles, auto’s, trucks, impounded until same is returned to quiet OEM status as per the Federal Code of Regulations, CFR 40 Part 205, a relatively quiet 80dB(A), properly labeled. The attached article expresses my concern and provides a viable solution to the LOUD motor vehicle thuggery in the United States that is more accurately defined as “domestic terrorism.” Kudos and respect to those who ride legally, respectfully, honorably, with their OEM-quiet-factory installed mufflers.

First of all, the obfuscation/misinterpretation by the Motorcycle Rights Organizations relevant to the U.S. EPA/Code of Federal Regulation’s “Acoustical Assurance Period” (AAP) located at Title 40 → Chapter I → Subchapter G → Part 205 → Subpart D → §205.152

(3) Street motorcycles must be designed, built and equipped so that, when properly maintained and used, they will not produce noise emissions in excess of the levels specified in paragraph (a)(1) of this section, for an Acoustical Assurance Period of one year or a distance of 6000 km (3730 mi) after the time of sale to the ultimate purchaser, whichever occurs first.

Don’t believe the obfuscation: The Motorcycle Rights Organization’s will attempt to defer or negate LOUD Biker culpability for illegally removing the OEM – Factory-installed motorcycle muffler and replacing same with an illegally loud NOT FOR ROAD USE muffler by obfuscating, misinterpreting the meaning and intent of the Acoustical Assurance Period.

Loud Biker advocates will tell you that the stock/OEM, quiet, factory-installed muffler is only “good” for 3730 miles or one-year from the time of retail/sale.  NOT TRUE – the original, U.S. EPA approved, factory-installed muffler is intended to remain in compliance for the LIFE OF THE MOTORCYCLE according to the author of the AAP, Kenneth Feith (Former EPA Employee).  The AAP is simply a “warranty period” required by the EPA from the manufacturer to the consumer to ensure the acoustical integrity of the factory-installed muffler…for more information, please see:

ACOUSTICAL ASSURANCE PERIOD (Excerpts from article)

“The regulation includes an Acoustical Assurance Period (AAP), which specifies a relatively short period during which a motorcycle’s noise abatement elements must be in compliance with the federal regulation during street usage.  Some have interpreted this to mean that, once the AAP has expired, the regulation no longer applies.  This wording of the regulation needs clarification that noise emissions limits apply for the life of the motorcycle.”

 “The EPA should make clear in the regulatory requirements that the tampering provisions apply to all persons for the life of the motorcycle.  In other words, noise limits for owners/operators remain in effect for the life of the motorcycle and do not expire at the end of the AAP.”
