Over this last week (May 16-19, 2017), Concerned Citizens Against Loud Motorcycles (C-CALM) accompanied Noise Free America in Washington D.C. to lobby for the protection of the motorcycle NOISE beleaguered American citizen. On my final day in D.C., I observed the D.C. Metropolitan Police Motorcycle Detail escorting Vice President Pence onto the White House grounds (see video below)…following is my Email to Chief Newsham of the D.C. Metropolitan Police regarding what I observed.
Dear Chief Newsham,
I was in D.C on Friday, 19 May 2017, standing at the intersection of 17th and Pennsylvania Avenue when I heard the D.C. Metropolitan Police Motorcycle Detail escorting Vice President Pence onto the White House grounds at that intersection’s entrance. I was disheartened to see this sharp, professional, motorcycle detail riding police Harley Davidson motorcycles illegally equipped with illegally LOUD Kerker aftermarket exhaust mechanisms affixed to approximately one-half of the fleet in the motorcade.
Chief Newsham, why are you permitting the D.C. Motorcycle Detail to ride in violation of the Federal Law that requires every street-use motorcycle be equipped with the US EPA compliant, properly labeled, quiet, motorcycle muffler? It is disheartening to see this elite, very visible, honored, motorcycle detail riding motorcycles that are blatantly illegal and emitting decibel levels that are, under hard acceleration, emitting in multiples (logarithmic scale) the legal, safe, “total” motorcycle noise emissions of 80 dB(A) as required by Federal Law via the SAE J331a testing procedure. The United States EPA restricts “total” motorcycle noise emissions to 80 dB(A) for one very significant reason: that 80 dB(A) is the “minimum” level of protection for the health and welfare of the United States citizen and is designed to protect their quality of life.
I see that D.C. has encumbered itself with redundant, unnecessary, sound meter legislation for motor vehicle noise emissions. Nonetheless, the noise emissions emitted by the illegal Kerker aftermarket exhausts most likely easily exceed the limitations of D.C. Motor Vehicle Code #2811. Shame on D.C. for usurping the protective intent of the Code of Federal Regulations Title 40 → Chapter I → Subchapter G → Part 205 → Subpart D → §205.152 which restricts street-use motorcycle noise emissions, 1986-year model forward, to a quiet and safe 80 dB(A). The Kerker exhaust on the D.C Police motorcycles are also in violation of Title 40 → Chapter I → Subchapter G → Part 205 → Subpart D → §205.158 of the Code of Federal Regulations requiring a US EPA muffler label on the muffler canister positioned in a readily visible location.
Our law enforcement community in the United States should be pillars of exemplary perfection regarding the rule of law and the protection of the health and welfare, the quality of life, of the citizenry they are sworn to protect and serve. Considering the out-of-control motor vehicle NOISE problems on America’s roadways, your compromise with NOT FOR ROAD USE aftermarket exhaust mechanisms on your police motorcycles provides a sense of legitimacy to the narcissistic behavior, illegal behavior, of the Loud Motorcycle Cult[ure] in the United States. Personally, I expected more from your elite Department.

2812 ALTERATION OF MOTOR VEHICLE EXHAUST SYSTEM
2812.1 No person shall modify or alter the exhaust system of a motor vehicle or motorcycle in a manner that will amplify or increase the noise emitted by the vehicle above the level permitted under §2811 of this chapter.
2812 .2 No person shall use or operate a motor vehicle or a motorcycle having an exhaust system that has been modified or altered in a manner that will amplify or increase the noise emitted by the vehicle above the level permitted under §2811 of this chapter.
